Do I have a claim?
Generally, you only have three years from the date of the accident within which to issue proceedings. Personal injury may be psychological, such as Post Traumatic Stress Disorder, as well as physical.
How do I make a claim?
If you think you may have a claim, please fill out our enquiry form as accurately as possible. Alternatively you could phone our office where you will be asked a series of questions by our professionals. Although we will need information about all parties, please do not worry if you only have limited information at present as this can be collected later.
How long will the claim take?
There is no set time period and it will depend on the complexities of the case. Generally, a claim may take 6-18 months; but in complex cases it may take much longer.
How much compensation will I receive?
There is no set amount, but the compensation you may receive will be divided into two parts:
- General damages- Incorporating pain, suffering and loss of amenity- This depends on the type of injury sustained; how long you were suffering from it, and any long term effects it may have.
- Special damages- Basically out of pocket expenses resulting from the accident. This will include any loss of earnings, hire of a replacement car, cost of public transport, cost of medical care and prescriptions etc.
How much will it cost me to claim?
In circumstances were we have agreed to act for you on a Conditional Fee Agreement basis, we will attempt to recover all of our costs from the third party at the successful conclusion of the case. In certain matters we shall enter into a Conditional Fee Agreement with you where we will be able to recover 25% from your total damages recovered as part of your claim, which will be in addition to any costs recovered from the third party. In the event that we are not able to recover all of our costs from the third party then we shall not seek to recover any shortfall from you.
